User Agreement (Terms of Use)

Please read these Terms of Use ("Terms", "User Agreement") carefully before using any mobile application ("App", "Application") operated by IP Bunkov Maksim Vladislavovich ("Bimawa", "we", "us", or "our").

By downloading, installing, or using our Applications, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Applications.

1. Acceptance of Terms

By accessing or using our Applications, you confirm that you:

  • Are at least 13 years of age (or the minimum age required in your jurisdiction)
  • Have the legal capacity to enter into this agreement
  • Accept and agree to be bound by these Terms
  • Agree to our Privacy Policy

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Application on your personal device
  • Use the Application for personal, non-commercial purposes

3. Restrictions

You agree NOT to:

  • Copy, modify, or distribute the Application
  • Reverse engineer, decompile, or disassemble the Application
  • Remove any proprietary notices or labels
  • Use the Application for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Application's functionality
  • Use automated systems or software to extract data from the Application
  • Sublicense, sell, or transfer your rights to use the Application

4. User Content

If our Application allows you to submit content:

  • You retain ownership of your content
  • You grant us a worldwide, royalty-free license to use, display, and distribute your content within the Application
  • You are responsible for the content you submit
  • You warrant that your content does not violate any third-party rights

5. Intellectual Property

The Application and its original content, features, and functionality are owned by Bimawa and are protected by international copyright, trademark, and other intellectual property laws.

All trademarks, service marks, and trade names are the property of their respective owners.

6. In-App Purchases

Some Applications may offer in-app purchases. By making a purchase:

  • You agree to pay all applicable fees
  • All purchases are processed through Apple's App Store
  • Refunds are subject to Apple's refund policies
  • We are not responsible for any issues with payment processing

7. Subscriptions

If applicable, subscription terms:

  • Subscriptions automatically renew unless cancelled
  • You can manage and cancel subscriptions through your Apple ID settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods

8. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The Application will be uninterrupted or error-free
  • Defects will be corrected
  • The Application is free of viruses or harmful components
  • The results of using the Application will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIMAWA SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Any damages exceeding the amount you paid for the Application (if any)

10. Indemnification

You agree to indemnify and hold harmless Bimawa from any claims, damages, losses, or expenses arising from:

  • Your use of the Application
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to the Application immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

  • Your license to use the Application ends
  • You must delete all copies of the Application
  • Sections that by their nature should survive will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Application constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Application shall be resolved through:

  1. Good faith negotiation
  2. If negotiation fails, binding arbitration in accordance with applicable laws

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bimawa regarding the use of our Applications.
